Before you send your letter
Describe the defect precisely
Identify the product by brand, model and serial number, with the purchase date, store or website, and price. Explain when the problem first appeared, how you used the item, and what exactly fails. Photos or a short video of the defect help. If you already contacted the seller or manufacturer, note the dates, names and case numbers, and any repair attempts. Keep the receipt or order confirmation; a clear purchase record is often the first thing a warranty department asks for.
Check the warranty and return terms
Look for a written warranty in the box, manual or product page. It should say how long coverage lasts, what it covers and whom to contact. The Magnuson-Moss Warranty Act sets federal rules for how written warranties on consumer products are stated and honored, and many states also recognize implied warranties, subject to valid disclaimers. A store return window is a separate policy. Knowing which applies tells you whether to write to the seller, the manufacturer, or both.
Ask for one clear remedy
Choose the outcome you want: a repair, a replacement, or a refund. If you choose repair, ask who pays for shipping and how long it will take. If the item has already failed after a repair, say so and ask for a replacement or refund instead. State the amount where relevant and give a reasonable date for a reply. A specific request is easier for a warranty team to approve than a general complaint. Mention any costs the defect already caused you, such as return shipping, only if you can document them.
If the answer is no
Ask for the refusal in writing with the reason. You can escalate to the manufacturer's customer relations team, ask your card issuer whether a billing dispute is available, or file a complaint with your state attorney general's consumer protection office. Small claims court is an option in many places for modest amounts. Keep the product and its packaging until the dispute is settled.
